FAMILY COMMISSION MEETING THIS WEDNESDAY!

  1. Can't make it - a few questions -

    1. Who are they really?
    2. What authority do they have? Do they just recommend changes to the practice book?
    3. Do they allow items to be placed before the commision in writing?

    Read the last minutes. I strongly agree with two of the items on the previous mtg.

    1. Having a hearing if you want to get rid of your lawyer before trial. But ONLY if the judge wants to hear the real problems of what is going on (besides money issues) and ORDER a course of action that must be followed to address the issues.

    2. Lawyers are hesitant to bring violations of standing orders to court. This conduct is abominable. I asked my lawyer to file numerous contempts but he didn't for whatever reason and it hurt my case cause if would clearly have shown my spouses contempt for court orders for which my spouse continues to flaunt. Just filed my 2nd post judgement contempt in 3 months.

    1. The vast majority of people in the Commission are judges--Judge Munro, Judge Solomon, Judge Abery-Wetstone, plus some Attorneys as well. I believe they are advisory and make suggestions for changes in the Practice Book which are then voted on at the Judges Annual Meeting, then implemented if approved. Usually such recommendations are approved unanimously. As you know, Judges really don't listen when you try to discuss complaints about attorney behavior, and attorneys will outright lie about you to the court and the Judges will claim to believe the lies, even if there is no evidence to support them. So no judge wants to know the real problem. As even Judge Solomon acknowledged at the meeting today, the situations where attorneys try to withdraw just before trial, or submit presigned in lieu of forms, usually occurs when the attorney has wasted the initial retainer on frivolous disputes, then has no money for trial, demands an additional retainer and is unable to obtain it from the client who is now broke. I think you mean automatic orders, not standing orders. The standing orders have to do with the witness and exhibit lists for trial. I hear repeatedly that when a spouse such as yours refuses to obey the automatic orders there are no consequences for that behavior. Judges just don't care. I don't get why. But I feel for what must be a greater story that you haven't told of your experience of tremendous frustration with the judicial system and I sympathize.
