Fox News reports as follows:  "A 17-year-old cancer patient and her mother are locked in an unprecedented legal battle with the Connecticut state government over the teen’s right to refuse chemotherapy treatment, Fox CT reported.

 

The girl, identified only as “Cassandra C." in court documents, was diagnosed with Hodgkin’s lymphoma in September. At the time, doctors at Connecticut Children’s Medical Center (CCMC) recommended she receive chemotherapy. After she refused treatment— with her mother’s support— Connecticut’s Department of Children and Families (DCF) stepped in."

"THE HOUR" REPORTS DCF ADMITS MISTAKES IN GONZALEZ CASE!

STAMFORD -- The state Department of Children and Families has admitted that it acted on a mistaken belief in taking a North Stamford mother's adopted son away from her, resulting in a two-year legal battle "riddled with errors and misjudgments," court documents show.


In its supplement to an appeals case filed on Sept. 12, the agency admits that "there was never a proper cause for Santiago G.'s removal from Maria G. and for his placement in state custody and subsequently never an opportunity granted for Santiago G. and Maria (Gonzalez) to begin to reunify."


"First, the only sustainable basis to warrant initial state intrusion into the lives of Santiago G. and Maria G. is now well-established to have been a mistake -- specifically the concern that Maria G. had engaged in human trafficking -- has been demonstratively disproven," the appeals supplement reads.

CT LAW TRIBUNE REPORTS "ASTRONOMICAL FEES ASSESSED TO LAWYER WHO TESTIFIED FOR GAL REFORM!

According to the CT Law Tribune, "A Connecticut lawyer who publicly voiced his concerns about high costs of guardians ad litem services was shocked by the timing of an Appellate Court decision in his own divorce case.

Just one business day after Gov. Dannel Malloy signed into law a measure that will provide greater oversight of GALs and their fees, the court approved $252,000 in fees for two court-appointed child advocates. Some pro se parents who lobbied for GAL reform said they had been devastated financially by bills that were only a fraction as large.

The appeal was filed by Paul Greenan, a former Skadden, Arps, Slate, Meagher & Flom trusts and estates lawyer who now has a practice in Stamford. He claimed in court documents that the GAL and attorney for minor children appointed in his divorce case collectively spent just four-and-a-half hours with his two children, though that total was in dispute."

MARCH 25, 2014 JUSTINA PELLETIER RULING!

Below is a copy of the March 25, 2014 ruling in Justina Pelletier's case.  What I find interesting is that CT DCF didn't want to take the case and kept on putting it back in Massachusetts.  I guess CT DCF didn't want to rush in where Angels fear to tread and for once showed some common sense.

I think it is striking how Judge Johnston quoted all these professionals who make negative comments about Mr. and Mrs. Pelletier.  What happened to the Pelletiers is what happens to so many of us, that is, we are abused and attacked and then when we seek to defend ourselves or to position ourselves so our circumstances improve, the Judges, Attorneys, GALs, mental health professionals, and others characterize us as out of control, angry, and unreasonable, etc. 

It is interesting how so many parents who are denied their fundamental human and civil rights, most particularly their rights to due process and to parent their children, when they start to protest this treatment find themselves generally vilified.  I think that is the most deeply hurtful aspect of being subject to these kinds of human rights abuses--the lies that get told about you, and the false characterizations. 


Suddenly, the fact that you have been a good citizen and a good friend to others, the fact that you have given of your strengths and abilities and shown compassion to your neighbors--none of that matters to Family Court or DCF because they are determined to destroy any shred of good reputation you might have in their desperation to justify their wrong doing, using any smear tactics they have available.  Sadly, this is what is happening in the Pelletier case.

According to Investigative Journalist Anne Stevenson, "Justina Pelletier's case in Massachusetts sends the resounding message that DCF should have their feet held to the fire for all the money they have spent keeping this child away from her fit and feisty parents. CONNECTICUT CITIZEN--JUSTINA PELLETIER--KIDNAPPED BY STATE OF MASSACHUSETTS!

A Massachusetts juvenile court judge on Tuesday awarded "permanent" custody of a Connecticut teen at the center of an interstate custody battle to the state of Massachusetts in a major setback for her family fighting for her return.

 

The ruling by Judge Joseph Johnston leaves it up to the state Department of Children and Families to decide whether or when 15-year-old Justina Pelletier should be returned to her West Hartford home, The Boston Globe reported.

 

Justina has been in the agency's custody since last February, when her parents took her to the Bay State to get medical treatment for a rare condition called Mitochondrial diagnosis. When she was taken to Boston Children's Hospital to be treated for a negative reaction to the flu last year, doctors determined that her problems were partly psychiatric and that a prior treatment at Tufts Medical Center constituted medical abuse. They contacted DCF, which took the girl.

Corruptct reports, "For over a year Jamaal Jacob and his story has been read and listened to from people from east to west. With many people supporting him as he spoke out about his child that was kidnapped by the Torrington D.C.F in Connecticut. It has been over a year since this nightmare has started for this family, they continue to miss, love and fight for the return of their daughter.

 

Jamaal and his fiance are still facing criminal charges, charges that carry a 10 year sentence. Criminal charges for the alleged abuse of their daughter, they have maintained their innocence, continue to do everything that is asked of them. Through all of this heartache that the department of children and families in Torrington Connecticut has caused, they have maintained hope that their daughter will return home, where she belongs.

 

As the trial in this matter did not bring their daughter home, they are appealing this matter. Giving up is not an option, continuing to fight for the child they miss so very much, a child that was happy, loved, in a healthy structured family with brothers and sisters, who miss her."
